OLRS files brief on behalf of employee in need of an accommodation

On October 5, 2009, the Ohio Legal Rights Service (OLRS) filed an appellate brief in the Tenth District Court of Appeals on behalf of a former employee of the Ohio Bureau of Workers' Compensation. OLRS alleged that Workers' Compensation refusal to reassign her to an available, vacant position as a reasonable accommodation for her disability violated Ohio Revised Code §4112.02. The Court of Common Pleas had granted the employer's motion for summary judgment, but OLRS argued on appeal that there remained genuine issues of material fact regarding her ability to perform the essential functions of the requested position and that the collective bargaining agreement did not prohibit the reassignment.
