PLEAS Lawsuit update: Judge orders preliminary injunction

United State District Judge James Graham ordered a preliminary injunction against the Department of Job and Family Services and the Department of Mental Health earlier today. The preliminary injunction prohibits the Departments from implementing proposed rules O.A.C. §§ 5101:3-27-02 and 5122-29-17 until further order of the court. The case will now be set for trial at a date to be determined by the Court.

The Court found that the Ohio Legal Rights Service, on behalf of Parents' League for Effective Autism Services (PLEAS) an association of parents and families who have received Medicaid services, has shown good cause and has met the requirements for a preliminary injunction.
