November 5, 2009: EPSDT case update
Judge issues order allowing additional plaintiffs in G.D. v. Lumpkin, a class action lawsuit against the Ohio Department of Job and Family Services seeking to require the state to comply with federal laws related to the state's Early Periodic Screening Diagnosis and Treatment (EPSDT) program. October 20, 2009: Doe Consent Order approved
Federal Judge John D. Holschuh of the U.S. District Court for the Southern District of Ohio, Eastern Division, ruled the consent order in the Doe v. State of Ohio was fair, reasonable and adequate. The terms of the partial settlement of this class action lawsuit filed by Ohio Legal Rights Service (OLRS) are effective immediately and will benefit 280,000 children with disabilities in Ohio's schools. October 19, 2009: Early voting
Voters can vote early at an early voting site or cast their absentee ballot for the November 3 General Election. Mailed absentee ballots must be postmarked no later than the day before Election Day or returned in person to your local county board of elections by Election Day. October 16, 2009: Health Reform Conference
Register now to attend the Health Reform for People with Disabilities Conference on Tuesday, October 27, 2009 at the Hyatt Regency Hotel in Columbus, Ohio. Scholarships and expense reimbursement funds are still available. To register, call the AXIS Center at 614-263-8076 or email axiscenter@aol.com or download the conference brochure and registration form (PDF file). This event is the Ohio Developmental Disabilities Council's annual conference. Ohio Legal Rights Service is a co-host of the event.

October 14, 2009: Family support
The FSCouncil, a grant from the DD Council administered by OLRS, ended on September 30, 2009. This group of family members and state agency representatives, as a final project, developed an issue brief on family support. Read the brief: Family Issue Brief from the Family Support Council (PDF file)

October 14, 2009: OLRS Programmatic Priorities for FFY 2010

October 9, 2009: Doe v. State of Ohio amended notice
The Court has recently extended the deadline for filing objections to the Consent Order in Doe v. State of Ohio, Case No. 2:91-cv-464, and will consider any objections filed in writing with the Clerk of Court on or before October 19, 2009. October 8, 2009: Disability Employment Awareness Month

October 6, 2009: Job accommodation case
OLRS files brief in the Tenth District Court of Appeals on behalf of employee in need of an accommodation

October 6, 2009: Crimes against people with disabilities
The U.S. Department of Justice, Bureau of Justice Statistics issued the first estimates of crime against people with disabilities. Among the results, young and middle-age persons with disabilities experienced higher rates of violence than persons of similar ages without disabilities. October 5, 2009: Mental Health Awareness Week
October 4 - 10 is Mental Illness Awareness Week, a public awareness and education campaign of the National Alliance on Mental Illness (NAMI). NAMI Ohio, in recognition of Mental Health Awareness Week, is sponsoring a showing of the movies "Minds on the Edge" and "The Soloist" on October 7 at the Capitol Theatre/Riffe Center in Columbus.

October 5, 2009: EPSDT lawsuit update
OLRS has renewed its Motion for Class Certification and awaits a decision by the judge in G.D. v. Lumpkin, a case that alleges that the Ohio Department of Job and Family Services violates federal law because it does not have a system in place that allows Medicaid eligible children to apply for and receive necessary treatment services from the Early, Periodic, Screening, Diagnosis and Treatment (EPSDT) program. October 5, 2009: Former OLRS director named director of SAMHSA
The President has appointed Pam Hyde as director of the Substance Abuse and Mental Health Services Administration (SAMHSA). Hyde was the executive director at OLRS in the early 1980s. Read the announcement: President Obama Announces More Key Administration Posts

October 5, 2009: Mental Illness Awareness Week
October 4 - 10 is Mental Illness Awareness Week, a public awareness and education campaign of the National Alliance on Mental Illness (NAMI). This year's theme is "Building Community, Taking Action." Read more: Mental Illness Awareness Week 2009

October 2, 2009: H1N1 and people with disabilities
H1N1 (swine) flu is widespread. For people with disabilities, it is important to make a Personal Emergency Plan and also to be aware that with any public health emergency, people with disabilities may face discrimination, or problems with accessibility, reasonable accommodations or unnecessary quarantines. October 2, 2009: Restraint and seclusion survey
The Alliance to Prevent Restraint, Aversive Interventions and Seclusion is asking parents and guardians of students with disabilities who have experienced restraint, seclusion and aversive procedures in public/private schools or residential facilities to take a survey. The deadline to complete the survey is October 12. For more information: APRAIS Survey on the Use of Restraints, Aversive Interventions and Seclusion

September 30, 2009: OLRS Commissioner's meeting
The OLRS Commission will meet on Monday, October 5, 2009 at the offices of the Ohio Legal Rights Service. For more information, contact OLRS.

September 21, 2009: OLRS files brief in support of guardianship decision
OLRS filed a merit brief in the Supreme Court of Ohio in Spangler v. Geauga County Board of Developmental Disabilities, a case involving a guardianship dispute. Read more: OLRS files merit brief supporting Court of Appeals decision in guardianship case

September 18, 2009: Housing-related complaints

September 18, 2009: PLEAS case update
A preliminary pretrial conference was held on September 16 and the parties agreed to engage in settlement discussions which may begin in October. The PLEAS case seeks to prohibit a reduction in medically necessary services for children with autism. Read the Preliminary Pretrial Order (PDF file)

September 17, 2009: Register to vote
In order to vote in the November 3, 2009 election, you must be registered to vote by October 5, 2009.

September 14, 2009: Restraint incident in Ohio school

September 9, 2009: Community integration

September 3, 2009: Restraint death case update
Three former workers of Parmadale Family Services were charged with involuntary manslaughter and child-endangering in the death of a teenager due to prone restraint. Read more: Workers charged with involuntary manslaughter in the death of a 17-year-old girl

August 28, 2009: OLRS submits comments

August 3, 2009: OLRS files amicus brief

July 10, 2009: Doe v. State of Ohio Notice and Consent Order
Federal Judge John D. Holschuh of the U.S. District Court for the Southern District of Ohio, Eastern Division, gave his preliminary approval of a consent order in the Doe v. State of Ohio lawsuit filed by OLRS. Judge Holschuh ordered that Ohio students with disabilities and their parents or guardians receive the consent order and notice of the partial settlement of this class action lawsuit. July 9, 2009: Procedure change assists Medicaid applicants
OLRS, Pro-Seniors, several legal aid societies and disability organizations were successful in establishing a new administrative procedure that will assist individuals unable to access Medicaid verifications due to physical or mental impairment. July 9, 2009: Name change bill signed
The Governor signed Senate Bill 79 which removes the words "mental retardation" from the titles of Ohio agencies, boards, commissions, and other entities. Read more: Governor signs name change bill

July 2, 2009: Preliminary approval of a consent order in Doe v. State of Ohio
The Settlement in Doe, the class action filed by OLRS, establishes procedures for the Ohio Department of Education to implement the Individuals with Disabilities Education Act and protect the rights of students with disabilities. July 1, 2009: Ohio Poverty Law Center

June 26, 2009: Community integration reports

June 25, 2009: SSA hiring initiative

June 22, 2009: Cleveland advocacy agency closing

June 19, 2009: "Name change" bill update
The Ohio Senate unanimously voted to accept the amendments made to S.B. 79 in the Ohio House of Representatives. The bill will remove the term "mental retardation" from the names of state and county agencies supporting individuals with developmental disabilities. June 18, 2009: OLRS Voter Alert

June 18, 2009: EEOC revises rules
The Equal Employment Opportunity Commission (EEOC) voted in favor of revising rules to conform to the ADA Amendments Act. Read more: New regulations will make it easier to establish disability under ADA

June 15, 2009: Commission meeting cancelled
The OLRS Commission meeting scheduled for Tuesday, June 16 has been cancelled.

June 9, 2009: Guardianship case update
The Supreme Court of Ohio will review an appeal in Spangler v. Geauga County Board of MRDD, a case challenging the Board's authority to move for removal of an individual's parent guardians and appointment of Advocacy and Protective Service, Inc. June 8, 2009: Supreme Court accepts case

June 1, 2009: Doe v. State of Ohio

May 19, 2009: Social Security benefits and felony warrants
The Social Security Administration, per a lawsuit agreement, changed the way it processes applications for individuals who have an outstanding felony warrant. Read more: Social Security can no longer deny or stop benefits in certain cases because of an outstanding warrant

May 18, 2009: OLRS comments on PASRR rules

May 12, 2009: OLRS' request granted for status conference
Judge Sargus of the U.S. District Court for the Southern District of Ohio has ordered a status conference in response to a request from OLRS. OLRS seeks to resolve an impasse related to the Martin consent order and the D.M. v. Butler County Board of Mental Retardation and Developmental Disabilities (BCBMRDD) class action. April 7, 2009: Temporary suspension of new special education cases
Due to the high volume of requests for representation in special education matters and pending litigation, OLRS is temporarily suspending new special education cases through the end of April. April 1, 2009: Legislative event and rally held

March 31, 2009: Sponsor testimony heard on MRDD name change legislation
On Tuesday, Senator Jimmy Stewart delivered sponsor testimony on Senate Bill 79, a bill that will change the name of the Ohio Department of MRDD and the County Boards of MRDD to the "Ohio Department of Developmental Disabilities" and the "County Board of Developmental Disabilities." March 31, 2009: Board of election officials receive voter rights training
OLRS and the Ohio Secretary of State's office conducted regional trainings to over 200 board of election officials in an effort to improve the voting experiences of people with disabilities. Read more: OLRS and SOS provide voter rights training to board of election officials

March 26, 2009: National award presented to OLRS and an OLRS client
OLRS and one of its clients received the Training and Advocacy Support Center's (TASC) Advocacy Award at the TASC Annual Conference. Read more: OLRS and Client Receive National Award

March 25, 2009: Voting registration deadline is April 6
You are encouraged to exercise your right to vote. Tuesday, May 5, is Primary Election Day. In order to vote, you must be registered no later than 30 days before the election. If you are not already registered, Monday, April 6 is the deadline. Learn more about how to register to vote. If you think you are eligible to vote and have problems with voter registration or other voting rights, contact the OLRS Intake Department.

March 19, 2009: Disability public policy legislative event and rally
The Voice of One - The Power of Many, an event presented by The Arc of Ohio, begins on March 31 with an all-day training on public policy advocacy. A rally will be held the next day and individuals with disabilities and their families are encouraged to schedule visits for that afternoon with their legislators to discuss policy issues.

March 18, 2009: OLRS provides questions and answers about Medicaid Buy-in
Do you live in an ICF-MR and want to participate in the Medicaid Buy-in for Workers with Disabilities (MBIWD) program, so that you can work and earn more without losing health care coverage? Have you been denied participation in the MBIWD program because of residence in an ICF-MR? March 18, 2009: OLRS will attend national trauma informed care meeting

March 9, 2009: OLRS submits comments on RSC rule

March 5, 2009: OLRS budget testimony

March 5, 2009: Fairfield Center update
OLRS, on behalf of several residents of Fairfield Center, filed an appellate brief challenging the district court's dismissal of their claims. OLRS files appellate brief to preserve community placement of residents at Fairfield Center

February 26, 2009: OLRS Commission to undertake study
Language included in House Bill 1, the 2010-2011 biennial budget, requires the OLRS Commission to undertake a study "concerning a potential transition" of federal protection and advocacy grants "from a public entity to a nonprofit organization effective July 1, 2011." February 19, 2009: OLRS' Annual Report now available

February 19, 2009: OLRS joins in amici curiae brief
OLRS, along with the National Association of the Deaf and the Ability Center of Greater Toledo, filed an amici curiae brief requesting that the Ohio Supreme Court accept jurisdiction of an appeal reversing a defendant's conviction where one of the jurors who heard the case was hard of hearing. February 18, 2009: OLRS comments on special education rules
OLRS submitted comments to the Ohio Department of Education on a proposed rule that sets forth standards for the admission, transfer, suspension, and expulsion of students at the Ohio state schools for the blind and deaf. February 17, 2009: Commission meeting scheduled

The Ohio Legal Rights Service Commission will hold a special meeting on Wednesday, February 11, 2009, at 3:30 p.m. at the offices of the Ohio Legal Rights Service. The purpose of the meeting is to review the Governor's executive budget recommendations regarding OLRS.

January 13, 2009: NDRN releases report on seclusion and restraint in schools
A report from the National Disability Rights Network (NDRN) identifies the abusive use of restraint or seclusion nationwide by school administrators, teachers, and auxiliary personnel, which has resulted in injury, trauma and death to children with disabilities. The report includes two cases investigated by the OLRS Ombudsperson section. January 7, 2009: OLRS wins appeal in guardianship case
OLRS won an appeal challenging the authority of a county board of mental retardation and developmental disabilities to remove an individual's parents as guardians and appoint Advocacy and Protective Services, Inc.
